Lembaga Zakat Selangor (“Zakat Selangor”) is committed to protecting your privacy in accordance with Malaysia’s Personal Data Protection Act 2010.

This notice outlines how Zakat Selangor collects, records, holds, stores, organizes, modifies, discloses, uses, and destroys your personal data in relation to zakat collection and distribution activities at Zakat Selangor (hereinafter referred to as “processing”).

“Zakat Selangor” or “we” in this notice refers to the Zakat Selangor headquarters and its branches in Selangor.

1. What is Personal Data?

What is Personal Data?

“Personal Data” refers to any information concerning commercial transactions that is directly or indirectly related to an individual, which identifies or can identify the individual from that information alone or in combination with other information held by Zakat Selangor, including any sensitive personal data and opinions expressed about that individual.

“Sensitive Personal Data” refers to information about an individual’s health or physical or mental condition, political opinions, religious beliefs and other similar beliefs, any criminal conduct or proceedings against them, biometric data, or any other personal data as determined by the Minister responsible for personal data protection through orders published in the official gazette.

“Biometric Data” refers to any personal data generated from technical processing related to an individual’s physical, physiological, or behavioral characteristics.

Notification and Consent

When you request information or use the services of Zakat Selangor, you may be required to provide your personal data to Zakat Selangor. By doing so, you consent to the use of your personal data by Zakat Selangor in accordance with this Notice. Your personal data may also have been submitted to Zakat Selangor by a third party (for example, by your spouse, a company in which you are a director, officer, or shareholder, or a partnership in which you are a partner) for services required by that third party from Zakat Selangor. In this context, the term “you” in this Notice also applies to any individual whose personal data has been submitted to Zakat Selangor and/or obtained through methods as described in Section 4 of this Notice.

You have the option, at any time, not to provide your personal data or to withdraw your consent to allow Zakat Selangor to process your personal data. However, failure to provide such personal data or your withdrawal of consent to process the personal data provided may result in Zakat Selangor being unable to provide services to you effectively and continuously.

What types of personal data do we collect?

The types of personal data we collect include, but are not limited to, name, contact address, age, occupation, marital status, financial information, identification card, passport, place of birth, and your transaction history.

We may collect your sensitive personal data if you are dealing with Zakat Selangor and it requires you to disclose such sensitive personal data to us.

We will only use your sensitive personal data to provide the services you require. If we process your sensitive personal data, we will obtain your consent beforehand.

The personal data we collect may be categorized as either mandatory or voluntarily provided. Mandatory personal data refers to data that we require in order to provide our services to you. If you do not provide such data, we will not be able to provide our services to you. Voluntarily provided personal data refers to data that is not required for us to provide our services. If you do not provide such data, you may still use our services.

The types of personal data that are mandatory or voluntarily provided vary depending on the services we offer.

If you are under 18 years of age, please ensure that a parent or legal guardian provides consent before you submit any personal data to us.

How do we collect your personal data?

We obtain your personal data through various methods, such as:

  • When you use any of the services we provide.
  • When you contact Zakat Selangor via various methods, such as application forms, emails and letters, phone calls, and conversations with our call center.
  • If you contact us or we contact you by phone, we may monitor or record the calls for quality assurance, training, and security purposes.
  • From analyses we conduct on your transactions.
  • We may also obtain your personal data when you participate in customer surveys or register for any of our competitions or promotions.
  • When we obtain any data and information from authorized parties (for example, regulatory or enforcement agencies).
  • When we obtain any data and information from third parties.
  • When you enter into any commercial transactions with Zakat Selangor, including but not limited to providing goods and/or services or your professional services.
  • From Zakat Selangor’s websites and other social media platforms.
  • From public sources.

What is the purpose of processing your personal data?

We may process your personal data for the following reasons:

  • To assess your application for any of our services.
  • To manage and maintain your account and facilities.
  • To evaluate your financial needs and to carry out contractual obligations between Zakat Selangor and yourself.
  • To respond to your inquiries and complaints and resolve disputes.
  • For internal functions such as evaluating marketing effectiveness, market research, statistical analysis and modeling, reporting, audit and risk management, and fraud prevention.
  • To provide data to organizations/companies authorized by Lembaga Zakat Selangor to deliver services or provide assistance in the form of money, essential goods, courses, training, and other related matters for your benefit.

In addition, we may also use your personal data to comply with regulatory requirements and for any other purposes related to the provision of the services you require.

To whom do we disclose your personal data?

Your personal data that we hold will be kept confidential. However, to enable us to provide services to you effectively and continuously, and to comply with any legal and regulatory requirements, we may need to disclose your personal data to the following parties as deemed appropriate by Zakat Selangor:

  • Majlis Agama Islam Selangor, the original entity authorized by DYMM Sultan of Selangor to collect and distribute zakat under the provisions of the Administration of Islamic Religion Enactment (Selangor State) 2003.
  • Zakat Collection Agents and Assistant Amils appointed by us to carry out zakat collection and distribution duties in Selangor.
  • Agents and service providers appointed by us to perform certain functions, services, and activities.
  • Government agencies, statutory bodies, and local authorities (PBT) for the disbursement of any form of assistance or service.
  • Our strategic partners, advisors, or consultants.
  • Enforcement, regulatory, and government agencies, as permitted or required by law, any court order, or to fulfill obligations to regulatory authorities.
  • Any credit reporting agency in Malaysia for the purpose of conducting credit and background checks on you.
  • Organizations/companies authorized by Lembaga Zakat Selangor to provide services or distribute assistance in the form of money, essential goods, courses, training, and other related matters for your benefit.
  • Parties authorized by you.

You may receive marketing notifications from us or other entities about services that may interest you. If you do not wish to receive such marketing notifications, please inform us to withdraw your consent, and we will stop processing and sharing your personal data with other entities for marketing purposes.

You have the option to withdraw your consent to receive marketing or promotional materials/notifications. You can contact us via the phone number or website provided in Section 11 below. Please note that once we receive confirmation of your request to withdraw consent for marketing or promotional materials, it may take up to fourteen (14) business days for the withdrawal to be reflected in our system. During this period, you may still receive marketing or promotional materials.

Please note that even if you choose not to receive marketing or promotional materials, Zakat Selangor may still contact you for other purposes unrelated to marketing or promotions, such as matters relating to your account, facilities, or existing services provided by Zakat Selangor.

If you have submitted a third party’s personal data to Zakat Selangor, please ensure that you have obtained consent from the relevant third party for the processing and disclosure of their personal data and that this Policy has been presented to the third party in advance.

How do we protect your data?

The security of your personal data is our priority. Zakat Selangor takes all necessary physical, technical, and organizational measures to ensure the security and confidentiality of personal data. If we disclose any personal data to the parties listed in Section 6, they are obligated to properly protect the personal data provided to them.

Zakat Selangor has appointed a Data Protection Officer (DPO) to ensure ongoing compliance with Act 709. In the event of a data breach, you should report the incident (such as data leaks or unauthorized use of data by third parties) to the DPO via email at dpo@zakatselangor.com.my.

How long do we retain your personal data?

We will only retain your personal data for as long as necessary to fulfill the purposes for which it was collected or to comply with legal and regulatory requirements as well as internal needs.

Changes to this Policy

Please note that we may update this Policy from time to time. If there are significant changes to this Policy, we will notify you by displaying a notice of the changes on our website within a timeframe we deem appropriate. 1. What is the Zakat Selangor Privacy Notice?

The Zakat Selangor Privacy Notice is a notice issued to individuals who have commercial transactions with Zakat Selangor. It outlines the use and protection of individuals’ personal data processed by Zakat Selangor as the “Data User” in accordance with the Personal Data Protection Act 2010.

The PDPA is an act enacted by the Government of Malaysia on 15 November 2013 to protect personal data and sensitive personal data of individuals in commercial transactions. The PDPA contains 7 general principles for the handling of personal data that must be complied with:

  • General Principle
  • Notice and Choice Principle
  • Disclosure Principle
  • Security Principle
  • Retention Principle
  • Data Integrity Principle
  • Access Principle

All individuals and organizations that process your personal data in their dealings must comply with the regulations set out by the PDPA, except for the Federal Government and State Governments.

Personal data is any information you provide when subscribing to Zakat Selangor’s products and services, allowing us to provide effective and efficient services to you. Your personal data includes:

  • Your identity (including name, date of birth, identification number)
  • Contact details (including address, phone number, and email address)
  • Other information (including your occupation and employer’s name)

Your sensitive personal data includes the following:

  • Health or physical or mental condition
  • Political opinions
  • Religious beliefs and other similar beliefs
  • Conduct or any offenses committed
  • Biometric data

Your biometric personal data includes the following:

  • Fingerprints
  • Identification information via MyKad
  • Other biometric personal data as required at the time

Zakat Selangor is the Data User that collects your personal data. A Data User is an individual or organization that:

  • Processes personal data, or
  • Has control over the processing of personal data, or
  • Allows the processing of personal data

A Zakat Selangor Commercial Transaction refers to any matter related to the products and services offered by Zakat Selangor, whether contractual or otherwise. This includes the collection of personal data from individuals who may potentially engage in transactions with Zakat Selangor.

Zakat Selangor takes comprehensive measures to ensure the security and confidentiality of your personal data through physical, technical, and IT security process requirements.

The PDPA defines “processing” as any act of collecting, recording, holding, storing, organizing, modifying, disclosing, or destroying personal data. Simply reading or accessing information is already considered “processing.” Examples of activities that may be considered “processing” include:

  • Collecting data using forms, via telephone, or through a website
  • Publishing data
  • Selling data
  • Using data in administration
  • Using data for marketing purposes
  • Recording data
  • Disclosing or providing data to other organizations
  • Destroying data

Your rights are as follows:

  • The right to be informed if your personal data is processed by Zakat Selangor
  • The right to access your personal data
  • The right to correct your personal data
  • The right to withdraw consent for the processing of personal data
  • The right to prevent the processing of personal data that may cause harm or distress
  • The right to prevent the processing of personal data for direct marketing purposes

Yes, Zakat Selangor will allow you to access your personal data that is stored in Zakat Selangor’s system.

Zakat Selangor may only refuse your request to access your personal data if your identity cannot be verified.

There are several situations in which another party may be allowed to access your personal data, namely:

  • If you are under 18 years old, only the legitimate account guardian is permitted.
  • Other entities within Zakat Selangor, such as its subsidiaries and related companies.
  • Authorized agents and service providers with whom Zakat Selangor has contractual agreements to perform certain functions, services, and activities.
  • Agencies established by the Federal Government, State Government, Statutory Bodies, and Local Authorities (PBT) for the purpose of providing any form of assistance or services.
  • Our strategic partners and advisors/consultants.
  • Other state zakat agencies.
  • Enforcement, regulatory, and government agencies, as permitted or required by law, authorized by any court order, or to fulfill obligations to regulatory authorities.
  • Any credit reporting agencies in Malaysia for the purpose of conducting credit and background checks on you.
  • Organizations/companies authorized by Zakat Selangor to provide financial aid, essential goods, courses, training, and other related services for your benefit.
  • Any party authorized by you.

With your consent, Zakat Selangor may process your personal data for the purposes of providing the products and services you subscribe to. This includes managing and maintaining your account, responding to any inquiries you may have, and also for evaluation and marketing purposes. Zakat Selangor may also send you marketing materials/notifications through various channels (such as email, letters, phone calls, and others).

Failure to provide your personal data, or withdrawing your consent for the processing of your personal data, may result in Zakat Selangor being unable to effectively and continuously provide products and services related to you.

If you do not give consent to Zakat Selangor for marketing purposes, Zakat Selangor will stop sending marketing materials/notifications about products and services to you. However, Zakat Selangor may still use your personal data to provide the products or services you have registered for, in order to fulfil contractual requirements, as well as for legal or regulatory purposes.

You may withdraw your consent for the processing of your personal data at any time by contacting any Zakat Selangor branch, calling the Zakat Selangor Hotline at 1300-88-4343, or by visiting www.zakatselangor.com.my.  

Zakat Selangor may take up to 14 working days before the withdrawal of consent is reflected in the system. This is because the withdrawal notice must go through a verification process across the entire Zakat Selangor group. Therefore, you may still receive marketing or promotional materials/notifications during this period.

If Zakat Selangor provides your personal data to an authorised third party, Zakat Selangor will ensure that they are under the same obligation to adequately protect the personal data entrusted to them.

Zakat Selangor will only retain your personal data for a specific period to fulfill the purposes for which it was collected or to comply with legal, regulatory, and internal requirements of Zakat Selangor.

Yes, if the personal data is processed in Malaysia before being transferred to parties outside Malaysia, it will be protected under the PDPA. However, the PDPA does not protect personal data that is processed outside Malaysia.

You can withdraw your consent to Zakat Selangor for marketing purposes at any time by logging into eZakatONLINE at https://ezo.zakatselangor.com.my/ and updating your consent in the Update Personal Information section.

Once you have done this, you will no longer receive marketing materials/notifications about products or services from Zakat Selangor. However, Zakat Selangor may still use your personal data to provide the products or services you have registered for, in order to fulfill contractual requirements and for legal or regulatory purposes.

You may withdraw your consent for the processing of your personal data at any time by contacting any Zakat Selangor branch.

However, withdrawing your consent for the processing of your personal data may result in Zakat Selangor being unable to effectively and continuously provide products and services related to you.

If you are a recipient of zakat assistance, withdrawing your consent may disrupt the aid and services that we are currently providing or plan to provide to you.

You are encouraged to update your personal data through the following methods:

  • Zakat payers and zakat aid recipients – For any access, correction, or updating of personal data, you may at any time log in to eZakatONLINE at https://ezo.zakatselangor.com.my under the Update Personal Information section, visit any Zakat Selangor branch, or contact any Zakat Selangor branch for inquiries.
  • Others – For any access, inquiries, correction, or updating of personal data, you may contact the Zakat Selangor officer handling your case directly or call the Zakat Selangor Hotline at 1300-88-4343.
